These Terms of Service ("Terms") apply to your use of moduvo.com.au and any purchase you make from MODUVO ("we", "us", "our"). By using the site or placing an order, you agree to these Terms. Please read them carefully.

2. Eligibility

To place an order, you must be at least 18 years of age (or have your parent or guardian's consent), be capable of forming a binding contract, and provide accurate contact and delivery information.

3. Products and product information

We make reasonable efforts to ensure product descriptions, images, dimensions and finishes shown on the site are accurate. Colours on screen are indicative only, and decors can vary slightly between manufacturing batches. Where dimensions or fit are critical, please contact us before ordering.

Our cabinets, wardrobe packages and wardrobe inserts are assembled by us in Moorabbin before they are delivered. Wardrobe inserts and custom sizes are made to the measurements you choose.

We may discontinue or change products at any time, but not once we have accepted your order for them.

4. Pricing

All prices are in Australian Dollars (AUD) and include GST. The price you pay at checkout does not include delivery: delivery depends on your address and the size of the order, so we quote it once we have your address and invoice it separately before anything is dispatched. Products marked "Price on request" are priced by quote.

We may change prices at any time, but changes will not affect orders we have already accepted.

If a price is displayed incorrectly because of an obvious error, we will contact you before dispatch. You can then pay the correct price or cancel the order for a full refund.

5. Orders and order acceptance

An order placed through the site is an offer by you to purchase. When you pay by card, the contract is formed once payment is confirmed. When you send your cart through for a quote, it is formed once you accept our invoice.

We may cancel an order before it is dispatched where:

• the product is unavailable;
• there is an error in the price or product description;
• we suspect the order is fraudulent or unauthorised; or
• we cannot deliver to the nominated address.

If we cancel an order, or cannot supply it within a reasonable time, we will tell you promptly and refund everything you have paid in full to the original payment method.

6. Payment

You can pay by card, Apple Pay or Google Pay at checkout. Card payments are processed by Stripe; your card details go to Stripe and never reach us or this website. Orders sent through for a quote, and delivery charges, are invoiced and can be paid by the methods shown on the invoice. By placing an order, you confirm that you are authorised to use the payment method.

7. Delivery

Delivery is governed by our Shipping Policy, which forms part of these Terms.

8. Returns, refunds and consumer guarantees

Returns, refunds, repairs and replacements are governed by our Refund & Returns Policy, which forms part of these Terms.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies you have under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded.

9. Limitation of liability

Nothing in these Terms excludes, restricts or modifies your rights under the Australian Consumer Law. If we fail to meet a consumer guarantee, you are entitled to compensation for any loss or damage that was reasonably foreseeable as a result.

Otherwise, to the extent the law allows, we are not liable for loss that was not reasonably foreseeable, or for loss caused by something outside our reasonable control.

10. Intellectual property

All content on moduvo.com.au — including text, images, logos, product descriptions, and the MODUVO name — is owned by or licensed to us and is protected by Australian and international intellectual property laws. You may not copy, reproduce, distribute or use this content for commercial purposes without our prior written consent.

11. Your conduct

You agree not to:

• use the site for any unlawful purpose;
• attempt to gain unauthorised access to any part of the site or its systems;
• interfere with the operation of the site, including by introducing viruses or malicious code; or
• scrape, harvest or collect data from the site by automated means without our consent.

12. Privacy

Your privacy is important to us. Our handling of your personal information is described in our Privacy Policy, which forms part of these Terms.

13. Third-party links

The site may contain links to third-party websites. We are not responsible for the content, products or practices of those sites. Visiting them is at your own risk.

14. Changes to these Terms

We may update these Terms from time to time. The version in force when you place an order governs that order; later changes do not apply to it.

15. Governing law

These Terms are governed by the laws of the State of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and any courts that may hear appeals from those courts.
